A consumer is an individual purchasing goods for purposes outside their trade, business or profession.
2. Products, Prices and Orders
The store offers art and creative materials, textile hardeners, pigments, coatings, tools and related products.
Product descriptions, quantities, availability and prices are displayed on the relevant product pages. Prices are in euros (EUR) and include applicable VAT unless clearly stated otherwise.
To place an order, the customer selects products, adds them to the basket, provides contact and delivery details, selects an available delivery and payment method, and confirms the order. The total payable amount, including applicable taxes and delivery charges, is displayed before the order is submitted.
After placing an order, the customer receives order information by email. If an ordered product cannot be supplied, the Seller will contact the customer to agree on a solution; amounts received for any unfulfilled part of the order will be refunded.
3. Payment Methods
Payments are made in euros (EUR). Depending on the order and the options available at the time, customers may be offered the following payment methods:
- Bank transfer to the Seller’s bank account in accordance with the order information or invoice. Please include the order number in the payment reference.
- Online banking payment, including via the Montonio payment solution, when activated and available during checkout.
- Bank card payment, if this option is offered during checkout or at collection.
- Cash payment, where payment upon collection is offered for the relevant order.
For bank transfers: Swedbank AS; SWIFT/BIC: HABALV22; IBAN: LV16HABA0550140071496.
The exact available payment methods are shown at checkout. Fulfilment of prepaid orders normally begins after payment has been received and confirmed. Electronic payments are processed by the relevant payment service providers under their applicable security requirements.
4. Delivery and Collection
Depending on the delivery address and availability, customers may choose an Omniva parcel machine, delivery to the provided address, or free collection at the Innovative Composites shop/warehouse, Vidzemes šoseja 4C, Sigulda, LV-2150, Latvia. Customers are notified when an order is ready for collection.
Delivery times for products in stock, calculated from order confirmation and receipt of payment where prepayment applies:
- Latvia – 1–3 working days.
- Estonia – 2–5 working days.
- Lithuania – 2–5 working days.
Delivery availability and times for other countries are agreed individually. These are normal delivery times and may vary depending on stock availability, order size, destination and carrier operations. The Seller will inform the customer of any anticipated delay and, where required, agree on a revised delivery date.
Unless another delivery period is expressly agreed, goods will be delivered no later than 30 days after conclusion of the contract. In the event of delayed delivery, the customer retains all statutory rights to request performance within an additional period or, where permitted by law, terminate the contract.
Delivery charges depend on the delivery method, destination, order size and weight. Applicable delivery charges are shown before the customer confirms the order. Collection in Sigulda is free of charge.
5. Consumer Right of Withdrawal – 14 Days
Consumers have the right to withdraw from a distance contract within 14 calendar days without giving any reason. The period is calculated from the day after the consumer or a third party designated by the consumer (other than the carrier) receives the goods. If goods under one order are delivered separately, the period starts after receipt of the last item.
Notification of Withdrawal
To exercise the right of withdrawal, consumers must notify the Seller of their decision by an unequivocal statement before the 14-day period expires, for example by email to info@powertex-baltics.com or by letter to SIA “MEIDI”, Vidzemes šoseja 4C, Sigulda, LV-2150, Latvia.
Consumers may use the model withdrawal form at the end of this document, but using this form is not mandatory. It is sufficient for the notice to be sent before the end of the withdrawal period.
Returning Goods
Consumers must return the goods without undue delay, and in any case no later than 14 calendar days after sending the withdrawal notice, to: SIA “MEIDI”, Vidzemes šoseja 4C, Sigulda, LV-2150, Latvia.
The consumer bears the direct cost of returning goods unless the Seller has expressly agreed to cover it. Consumers may inspect goods only to the extent necessary to establish their nature, characteristics and functioning, and are liable only for any diminished value resulting from handling beyond what is necessary for that purpose.
Refunds
Following a valid withdrawal, the Seller will reimburse payments received from the consumer, including standard delivery charges, without undue delay and no later than 14 days after receiving the withdrawal notice. Additional costs resulting from a delivery method more expensive than the least expensive standard delivery offered by the Seller will not be refunded.
The Seller may withhold reimbursement until the goods have been received back or the consumer has provided evidence of having returned them, whichever occurs first. Refunds will be made using the same payment method as the original transaction unless the consumer expressly agrees otherwise, and without any additional fee for the refund.
Statutory Exceptions
The right of withdrawal does not apply only in cases expressly excluded by law, such as goods made to the consumer’s specifications or clearly personalised goods. Any applicable exception will be explained before purchase. These Terms & Conditions do not limit statutory rights in respect of non-conforming goods.
6. Defective or Non-Conforming Goods
The Seller is responsible for supplying goods that conform to the sales contract and applicable legal requirements. Consumers may make a claim concerning non-conforming goods within the statutory two-year period after delivery, in accordance with applicable law.
Depending on the circumstances and applicable law, consumers may be entitled to repair or replacement, a price reduction, or termination of the contract and a refund.
Please send claims to info@powertex-baltics.com, including the order number, product name, a description of the problem and, where possible, photographs. Statutory remedies for non-conforming goods are independent of the 14-day right of withdrawal.
7. Complaints Handling
Complaints concerning orders, payments, delivery or product quality may be submitted in writing to info@powertex-baltics.com or sent by post to the Seller’s registered address.
Customers are encouraged to provide their name, contact details, order number, a description of the problem, the remedy requested and any supporting evidence.
The Seller will provide a written response to a written consumer complaint within 15 working days after receipt. If objective circumstances prevent a response within this period, the Seller will promptly explain the reason for the delay in writing and indicate a reasonable period within which the response will be provided.
8. Alternative Dispute Resolution
The parties will first seek to resolve disputes through direct communication. If no agreement can be reached, consumers may contact the Consumer Rights Protection Centre of Latvia (PTAC): https://www.ptac.gov.lv/en.
Where applicable, consumers may refer the dispute to the Consumer Dispute Resolution Commission or another competent alternative dispute resolution body. Consumers residing in another European Union Member State may seek assistance from the European Consumer Centres Network (ECC-Net): https://www.eccnet.eu.
Consumers retain the right to bring proceedings before a competent court.
9. Personal Data Protection
Customer personal data are processed for accepting and fulfilling orders, processing payments, arranging delivery, customer communications, accounting and compliance with legal obligations.
To the extent necessary to fulfil an order, relevant data may be shared with payment service providers, delivery companies and other relevant service providers. Further information is set out in the Privacy Policy published on the Powertex Baltics website.
10. Applicable Law
These Terms & Conditions are governed by the laws of the Republic of Latvia. Mandatory consumer protection rules applicable in other countries are not prejudiced by this choice of law.
11. Amendments
The Seller may update these Terms & Conditions. Orders are governed by the Terms & Conditions in force when the order was placed, except as otherwise required by mandatory law. Changes do not affect the rights arising from contracts already concluded.
